Can I fight a ticket in court for driving later than 12 a.m. when I am 19?

I agree!!! If the law is you must be over 18 to drive past 12am, I would ask the judge why you are appearing before him. I would think that the cop would give you a "fix it" ticket to get the paperwork straightened out. At the end of the day you have not broken the law! I think you could definitely challenge this one and win! I would go to the DMV and get the paper work fixed, then appear before the judge and tell him the scenario and add that you have already taken care of the DMV paper work. How could he charge you ????? Its gonna be a pain but it will save you $250 bucks!
 
I was pulled over for not using my blinker on a turn. In Georgia, you are supposed to change your license to class C when you turn 18. I am 19 and was out at 1:30, just to get some food. The cop gave me a ticket for being out past 12:00am even though the entire purpose of that law is to make sure young kids aren't out late. My license does not expire until 2012, I just never took it to the DMV to change from class c to d. I am a full time college student with a part time job and do not have any time to wait at the DMV for hours to get it changed. Do you think a judge will be sympathetic to this in court or is there any way to have it dismissed? My fine $250 and I think it is absolutely ridiculous

Dont try the "I dont have time" excuse..wont cut it for me or the judge. You make time buddy. It is your responsibility..no one elses..pay up
 
So you think the law is ridiculous? Then change the law. Start petitioning your state legislators, get the signatures you need and present it to be changed in the state legislature.

Otherwise, cut the excuses. Go to court if you must to try to whine your way out of what you admit is your own fault and see the judge add court costs, fines and other penalties because he is tired of hearing how everyone these days "don't have time". You have time to go on Yahoo! Answers and complain about it don't you? Then get over to the DMV and change the paperwork. Or get online and see if you can change it online.

Or just do what you should. Pay the fine and let it go. Your choice. A day missed from university or work, added court costs and fines/penalties, etc. Or you can take the time you would be spending in court and spend the few minutes necessary to change the paperwork. You go to court, you could be there all day. In that amount of time you could have changed the paperwork and paid your fine.

It's your fault, no one elses. Stop trying for the sympathy vote.
 
The TADRA law in Georgia reads a little vague as it says No driving between the hours of 12 a.m. and 6 a.m. No exceptions with a class d.

However since you are over the age of 18 and haven't had time to get your new class c license you may be able to fight it in court if you go to the dmv and get your new class c license before going to court the judge will be more lenient as you have already took care of the problem and may dismiss it

"Class D license holders are limited to the following conditions:
• cannot operate a motor vehicle between the hours of 12:00 AM and 6:00 AM"

The law don't say anything about age, so you could be 20 years old but if you still have a "Class D license" then you cannot operate a motor vehicle between12:00 AM and 6:00 A.M.
