Can i buy the HTC Tilt2 on ebay and not have to pay for internet?

I want to buy the at&t tilt2 but i would have to buy the $30 month data package. Could i just buy this phone on ebay and activate it at home to avoid paying for the internet? I wouldnt use it anyways.
