Can I arrest a business owner for fraud if he misrepresented his ability and took money?

I contracted a business for a website and paid up and over the contracted price into th 24,000 dollar range and was given something that did not work and can not be fixed due to his incompetence in building it. I brought him to civil court and won judgement of 5000 dollars, I would have brought him to letigations but he would have jumped paying as he has on this judgement.

When we met him he said he was fully capable of providing the services in the contract.

He was not able and kept taking money although he knew and later admitted in the civil case he was not able to do what was contracted.

But unbeknown to me, I was paying him to try to figure things out.

I believe I was defrauded and the judgement in the civil court states that they are perplexed that he kept using is incompetence as an excuse.

I'm fed up with this guy, he hasn't paid me my money, and there is nothing you can really do about it in terms of collecting a debt owed to you. (Don't sue it's not worth it)

But if I can have him criminally convicted I will.

Anyone know the answer?
 
I recommend that you report him to the fraud division of the local District Attorney's Office and see what the District Attorney says.
