At my shop. I had to evict a solicitor who was being too aggressive and followed my customers (and scared some away making me lose business) & Employees into the parking lot.
I gave her two verbal warnings to "leave the premises or I'll call the police and have her arrested for Trespassing" She refused
Now even though I am a tenant at this property. I am renting the BUILDING and not the parking lot itself. ( But the parking Lot is still Private Property to which I have more of a right to be there than her obviously)
At the same time I have a Guard Card Issue in California. So I know how to perform a trained Citizen's Arrest & Evictions. But i wasn't working as a guard but rather as a shop owner (Family Business). Or I'm basically guarding my own store & business interest's
Would I be in the wrong if I pressed charges against her for Tresspassing because she refused to vacate the parking lot and instead continue trying to sell her Pyramid Scheme Scam?
There is no "No Soliciting", "No Tresspassing", "No Loitering" signs anywhere visible on the property. But shouldn't a verbal warning be enough (witness's are available who heard me ask her to leave) let alone 2?
The Landlord is actually a Property Management company. They only show up in the complex when Tenants leave or new ones come. And they have their own hired security to protect the Tenants. But they're only there after store hours for the Graveyard shift. So what does everyone think?
