have to go to court? I sold an xbox 360 to a guy on craigslist and he came to my house and tested it before he bought it. A few hours later he emailed me saying it is broken, there are loose parts inside and the faceplate is broken.

He wants a refund or he is going to sue me.

Can he actually sue me and will I have to go to court?

Yes he can sue you and you would go to court, but it does not mean he would have a snowballs chance in hell winning the case.

Tell him you are sorry but it was working fine when he tested it and the sale was completed. From that point on it is his responsibility. There are no returns or warranties on used items. If he wanted a refund or warranty he should have bought a new one. Courts are not going to believe the unit was broken at time of purchase. A broken face plate would have been obvious at the time of purchase. That itself is evidence he broke it. And since he picked it up he had every opportunity to make sure it was in good working order. If you shipped it to him when he could claim it arrived damaged.
Don't let him scare and bully you.

Be polite in replying (even though he doesn't deserve it), and explain that there's no shot in hell that he'll gain any sort of compensation. You could also provide the link to this page if you wanted to, the guy could see firsthand what people will say.
 
He really can't do shit because it's your word against his. He could say it was broke, and you could say "no it wasnt" I dont even think it will go to court unless he has valid proof. I would tell him "Breaking it voids our return contact, all sales are final. Suck it."
 
If I were you I'd let him take you to court. He doesn't have a chance. He tested it before he took it. In court he will have to present evidence that you broke it which you didn't so don't give him a refund.
