Business selling counterfeit?

I purchased some mobile phone earphones today from a phone shop. I've been going to this shop for the past couple of years, so I didn't bother to check the actual earphones. However, I already had a pair of genuine earphones of the same kind at home. I compared them both at home, and it's pretty obvious that the ones I bought are fake.

Is it illegal for them to sell counterfeit products?
 
Are they fake or compatibles? Its illegal to sell anything counterfeit but compatibles are legal. If they are labeled as genuine nokia but clearly aren't genuine then you have a case against the shop.
 
Of course it is even if they inform you before hand.

If you want you could take it back to the shop however if you get hassle contact the brand directly and speak to them, whilst they may not replace your headphones they may take action against the store also contact trading standards

Finally contacting the brand involved they will be able to prove the item is fake and you could use this basis to take the shop to a small claims cout to get your money back (though it might not be worth it really but still contact trading standards)
 
Yes, it's illegal to sell knock-off products.
On the one hand it violates the original manufacturer's copyright and patent, and on the other the product was fraudulently passed off as an original item to the consumer.
