I made a $215.75 payment of to Herff Jones (class ring designer) for a ring. The day they were going to deliver the ring to my school, I was going to give them a money order for $175.75 which would pay off the ring and I would receive it in person at my school (this was a method of payment herff jones allowed). I got sick and was absent the day they came to my school with my ring. They returned to my school about a week later but I was still sick and absent.
They gave to option of completing the transaction online by a certain date. I was unable to get online and do it. And now it is past the date to do it online. My question is, can they legally keep my first payment of $215.75 just because I failed to pay it off by their time? To be clear, I have received no ring and I did not fully pay it off. Do they have to give me my $215.75 back or are they in their rights to keep it even though I received nothing for it?
