Broken Frame Letter

To be completely honest with you, I feel that your concerns are completely valid and justified. Having said that, I don't think your request for a letter specifying the particular elements that you'd like to see in the letter will be granted. Legally speaking it sounds like HD (dealer and MoCo) are making reasonable attempts to resolve the issue for you. Again, I find no fault with your feelings or effort to articulate your preferences to HD, but I wouldn't be surprised if they declined to write any more letters. If you have direct contact with HD (Milwaukee) your best bet just might be asking for a replacement bike. Don't know if they'll go for it, but it doesn't hurt to ask since you've already established a dialog with them.

it sucks that you got the "Bad Egg", and I do hope it all works out for ya...I would be pissed as well since you haven't had the bike that long. The one thing I don't agree on is the continous mentioning of your child....I don't think the MOCO is gonna be moved by that because thats like saying everyone else who rides isn't that important...only you are. I think you do deserve a new bike....but not because of the "kid" factor. your letter contraindicates itself. I would have called the MOCO....if you didn't get want you wanted from calling...then I'd have a letter typed, but from someone like a lawyer or somebody. (after the local lemon laws are checked into) just my .02

the same nonconformity has been subject to repair four or more times by the manufacturer, converter,or distributor, its agent, or its franchised dealer and two of the repair attempts have been made within a period of 12 months following the date of original delivery to an owner, or 12,000 miles, whichever occurs first, and the other two repair attempts occur within the 12 months or 12,000 miles immediately following the date of the second repair attempt, whichever occurs first, but such nonconformity continues to exist;


the same nonconformity creates a serious safety hazard and has caused the vehicle to have been subject to repair two or more times by the manufacturer, converter, or distributor, or an authorized agent or franchised dealer, and at least one attempt to repair the nonconformity was made in the period of 12 months or 12,000 miles, whichever occurs first, and at least one other attempt made in the period of 12 months or 12,000 miles after the first repair attempt, whichever occurs first, but the nonconformity continues to exist; or


the vehicle is out of service for repair for a cumulative total of 30 or more days in the 24 months or 24,000 miles, whichever occurs first, and at least two repair attempts were made in the first 12 months or 12,000 miles immediately following the date of original delivery to an owner and a nonconformity still exists that substantially impairs the vehicle's use or market value. The initial 12-month period or 12,000 mile limit, the subsequent 12-month period or 12,000 mile limit, and the 30-day period shall be extended by any period of time during which repair services are not available to the owner because of a war, invasion, strike or fire, flood, or other natural disaster. During any period of time that the manufacturer or distributor lends a comparable motor vehicle to the owner during the time the vehicle is being repaired by a franchised dealer, the 30-day period provided for in this subsection is tolled.

In either case, it's a warranty claim.
A missed weld, not broken.
HD is trying to cover it.
OP appears to want something for nothing.
OP should count his blessings that HD is offering him a loaner bike, at no charge.
This is NOT part of the warranty.
 
Hope you are happy now... there is a robot walking the streets of York, PA because it missed a weld on your scoot! LOL

Seriously, I'll bet that your scoot will get more attention from the dealer than it will from a group of workers in the factory. The dealer does not want to have to revisit this problem or face you if they screw up on reassembling your scoot.
 
I sympathize with your plight, but I cringe when I read pseudo-legal letters like this. You twice mention God and your daughter three times. I understand you're upset, but the letter is dripping with emotion.

One tip, not to be a PITA, but whenever someone uses an expression like "to be honest with you" or "honestly", it means everything else they've been saying is BS. That's a fact.

Look where you twice used those expressions -- you state that even if the MoCo does all the things you need, "honestly" you won't ever be happy. That's the bottom line. You've shown your hand and told them that even if they jump through all your hoops, it won't be enough, so what motivation do they have to do anything more than the minimum? Either way, you plan to be a thorn in their side for all eternity.
 
It's a tough decision for you. If you really want peace of mind then trade it now and be done with it. As for worrying about whether a technician can put your bike back together properly, they can !!! I worked as a parts mgr. at a dealership and we had several wrecked bikes that required replacing the frame. It takes a while but it can be done properly. Local techs have torque wrenches too you know !!! Some on here are worried about whether the tech really gives a crap or is hung over....... these same type people work on the factory assemly line too you know !!!
 
It's sad to say but in todays world,most techs are rushed becuse of flat rate pay scales,etc-.

What I would do is ,buy a manual and check the fastners when you get it back.

Also make sure you inspect the bike from top to bottom before your azz hits the saddle.

It sounds like Harley and your dealer have treated you right and in a timely manner. This is good to know. Thanks for posting your results.

You mentioned that you were a Goldwing owner that went thru Honda's cracked frame problems (years 2001 thru 2004). As a former owner of a 2005 Goldwing I followed Honda's problem closely. If I remember right, there were guys that had their entire frames replaced as well as those that had them rewelded. Some guys reported being down for months. No one reported receiving a new motorcycle or a loaner.

Furthermore, even the simpliest maintenance item on a Honda requires major surgery. For example, it took me 6 hours to change the air filter the first time. Yet you trusted Honda dealer mechanics to disassemble your bike and a non factory welder to reweld the frame. You also trusted your repaired bike for 140,000 miles. Why?

(I bet that mother Honda never responded to your letter.)
