Breach Of Verizon Contract?

It was in December that they changed their plan to require the data and changed the ETF. What happened is when you got your new phone they got you to sign a new contract. You probably just thought you were signing for the phone but you signed a new contract. Your best bet is to talk to your local store manager and explain what happened they are usually pretty lenient and they might work with you.
 
In december 2009 I upgraded my phone to the Samsung Rogue. I specifically chose this phone because the representative told me I could turn off the $9.99 data package. I went in today to turn it off and they told me I can no longer do that. I tried talking on the phone and in person now to see if I could just upgrade to a smartphone. They said I had to wait 16 more months, or pay a $350 cancellation fee and loose my $400 deposit. So to sum it up, they changed my contract without my notification, is there anything I can do?
I signed up mid december, I was told that it was changed on January 18th, thats a pretty big gap.
