Bike accident on the highway leading to death of the pedestrian?

My friend had an bike accident in which the pedestrian getting hit died and my friend just survived but with injuries.It was the fault of the pedestrian who was trying to cross the road on a highway jumping the barricades which was even not a crossing point.But now traffic police has registered a case against my friend under section 304 (A) and section 279.My friend is ready to give the compensation.Can this case be solved out of court?under section 304(A) can my friend be jailed.Please suggest how to go ahead with this case.
