Bearded dragon tank???????

hi i have a baby beardy (rex) and he is about 5 1/2 inches from snout to tail.
he is in a ten gallon tank and it is a bit small but not much. when do i need to upgrade to a 40
when he eats, his jaws kinda flex. is this normal? he eats well and has all nessasary lights
 
Move him when he's about 10 inches long and I don't know about the jaw problem hopefully someone will answer it.
