Are there any movies in which the baddie(s) come out on top? (possible spoilers)

Most of the Harry Potters end with the villain sort of coming out of it well (I know they're adaptations, and they end that way because there are follow-ups, but still! :p)

Philosopher's Stone - Voldemort escapes.
Prisoner of Azkaban - Pettigrew escapes.
Goblet of Fire - Voldemort fails in killing Harry but Cedric is killed.
Order of the Phoenix - Voldemort again escapes.
Half Blood Prince - Dumbledore is killed, the Death Eaters escape.

Also, "Urban Legend" - The killer, presumed dead, turns up alive in the final scene, obviously setting her sights on a new batch of students.

This.

Regardless of him being captured by the end of the film, he always comes out on top and always has a plan. A masterful and unforgettable villian.

A UK film called Daylight Robbery enRAB with the robbers getting away with the cash, though some of them do end up in prison, it's kind of implied they're going to meet up once they get out.

Did they? Oh, I don't remember being asked in your survey. Anyway, another discussion for another day. ;)

Another film where the "baddies" arguably come out on top is Spartacus. Mind you, the human spirit is shown to come out on top, even if Crassus does slaughter the rebels in the end.

Yet another could be Henry: Portrait of a Serial Killer, although that comes under "getting away with it".

House of 1000 corpses

great ending that left it up to the viewer.

Did derek go back to the "white power" lifestyle or move on over the death of his brother. My personal view on this is that he went back to the lifestyle that almost destroyed him.
