I have had my bicycle stolen from my apartments “secure” underground car park. The car park is designed to be accessible only through a roller shutter and remote controlled key fob, however the doors to the adjoining hotel is broken and they have been leaving it open during the day - allowing access into our car park. Although there are signs that read “Vehicles and contents are left entirely at owners risk. The management cannot take responsibility for loss or damage to vehicles or their contents. This area is covered by CCTV”, I have since learnt that the CCTV is not even switched on! Can I pursue my management company for my loss because of their failure to show a duty of care?
