Are military commissions or American federal courts the best option for

trying Guantanamo bay detainees? What are arguments both for and against these options and do you see any other potential options? Please only legitimate responses only that have some fact to back them up. Thank you.
 
The military commissions are better because all members of the court (attorneys and jurors) will have security clearances and as a result information developed from classified sources can be presented at the trials.

Civilian trials create the issue of our inteligence services refusing to divulge information that may comprimise classified intelligence gathering techniques and capabilities. Since there would be no way to know if any of this information may be useful in the defense of the accused there is the risk that any conviction may be overturned on appeal because there was no fair trial.
 
Well, considering that they were taken during a combat action and that much of the evidence was obtained, without the same rights a US citizen has, many of the witnesses are confidential and/or overseas, I'd say the rules of our civilian courts would automatically dismiss most of the charges. Further, there is really no precedent in our court system for this.

This is exactly the type of situation that military tribunals have been set up for in the past.
