Are doctors legally allowed to give a patient a *new* prescription over a fax?

UGH! i hate my doctor's assistant! We called yesterday..3 times..and she FINALLY picked up..then she was like "oh...well..i'll call you back"...she called back..saying she would call today..and it took her a while..so i called the Neurologist's office...
no answer..
UGH!
