So heres the story. I was out a week ago saturday with some friends at a bar. We walked outside on to a deck they have out back to smoke a cigarette when all the sudden a large heavy outdoor space heater came falling down and fell directly on top of my right foot. it was rediculously painfull imediately everybody gathered around my friends called for the manager who came out and asked if i was ok and took down my name and number from a friend.I dont like bieng the center of attention so I left on a friends back because I couldn't walk. I woke up a few hors later and my entire foot was swollen and bruised i went in to the emergency room and told them what happened, they took x rays but said that they didnt see anything broken and sent me home with an air cast and crutches and said to fallow up with an orthapedist in a few days,I did and they said that i have a lis frank injury and I will have to have surgery to correct it. I have 3 kids at home one of them only bieng 11 months and still doesnt walk yet. they said its a non wieght bearing injury meaning i cant lift her or anything. i also cant drive meaning I have no way to get my other 2 kids to and from school and I also babysit to make extra money and i can no longer do that either. My husband has had to stay home and miss a lot of work to be here to help putting us out of a lot of money.When I went back in to the bar to ask for an accident report they said they would not give me one and wont be held liable for something that is my fault. They said that I had to of sat on the heater for it to fall and they have me on camera but when I asked to see it they said no.I dont remember sitting on anything but I wiegh a whole 93 lbs. Dont you think that even if they had a heater up that was that unstable that drunk people could bump in to it and it falls down they should still be held liable? Do you think I have a case?
