I was travelling and i was ready to take a left turn onto a left street to continue to get to where i wanted to go, i leaned to the left hand side of the lane as i was about to lean into the street the car infront of instead of continue she instantly indicated and turned left at the same time no warning into the same street i was leaning into then she didn't check and done the turn extremely quickly. i saw this happen and i hit i believe her lower back left bumper once she make the turn i knew it was over and jumped off the bike onto the grass, the bike landed on the left and is completely written off.

She came out and said
"I did not check for motorcycles"
"it was a last second left turn because i was using the phone".

I raged telling her that she didn't indicate properly or check and wtf you on the phone for? i could of died. Police came and took statements but i won't hear from them for another week. I only just got my bike recently and only got CTP and REGO, i am waiting for her insurance company to contact me and analyse the situation. I know for a fact that she was in the wrong and its her fault but the cop said its difficult to determine in this situations. so i am really worried they can turn around and say its my fault. Although the damage is minimal on her car the bike is written off and it cooperates my story. just want to get some peoples opinions.

What you guys think?

I THINK ITS HER FAULT FOR SURE BECAUSE YOU CAN'T BE ON YOUR PHONE AND BE DRIVING.

It sounds like you may not like the outcome of this one. Her insurance may and would probably consider this that you were following her too close and hit her in the rear, so therefore your fault. But it should be her fault that she took the turn to quickly and used her turn signal late, but that can be difficult to prove and it's her word against yours.

Sorry that this happen, but I think it's very possible her insurance would deny your claim.

It depends on how much your bike was worth. It might be cheaper for her insurance company to pay for your bike instead of fighting you in court.
