I'm about to open a new online gift shop and I've come up with a name I love; however, I've searched the name on google and its already being used by a shop in Germany (although they sell a completely different product). Does this mean they already have the rights to the name and would it be illegal for me to go ahead and use it? If so, would it be a different matter if I added 'Online' to the end of the name in the email address, etc, but didn't use 'online' in my logo? The domain name including 'online' is yet to be registered in the UK so that would be fine in terms of setting up a website. Any advice appreciated!
