AB 435, CA Noise bill on Gov desk

I just did a search for AB 435 on the entire forum here and only found two and they were from 09... Surprised there isn't more banter here - I post mostly on the Touring so I will post this here.

This is for Ca only right now but you can bet IF it passes, other states will follow. The bill is on the Gov desk right now for his signature - I am betting it will pass.

It started out as a Smog bill for Motorcycles - over several adj - it now is for an EPA sticker that will monitor NOISE ..... for any and all (New) motorcycles purchased after Jan 1, 2013.

So, IF you are thinking of getting a new bike... get it before the cut off date - of course if the bill dies then all is good.... I am betting it gets signed and goes into CA law...

CA already has a law on noise but never really used - this bill will be very different.

Hey in CA its against the law to use a cell phone while driving... How good is that law and all kids are "by Law" suppose to have a helmet - ya, that one is enforced..

Now CA will have another stupid law ...

I have heard of this, its not the first time they have tried. It will pass sooner or later, that way the state can have smog tests to tax us more, and stop those who ride with no baffels.
 
Another reason to pay for something. Just an excuse to get out of debt in my opinion. Here in ND we dont't even have yearly inspections for our cars. I am hoping that is stays that way. I would think the politicians in this country especially that state have bigger and better things to worry about. Guess thats why we have to go after baseball players for roids. Who knows???????????
 
This is a tough question to me. I think there's abuse on both ends of the conversation. The government wants more money and they'll do it anyway they can...taxing us any way they can. Then you have the bikers who bring this crap on themselves. Is there really a need to throttle the crap out of your bike in a residential neighborhood or down a very crowded st?? That's not freedom of expression to me....its just dumb. I think just like everything else in life, people should have the option to have loud pipes on their bikes...as long as its not abused(which is usually the case).
 
Being a LEO (Motor Officer) I deal with mostly traffic and accident investigations in Southern California. If SB 435 passes I believe this will fall into the same category as altered emissions parts and the location of the C.A.R.B. number. Having attended a street racing school which involves being certified to inspect vehicles for altered emission parts. The most common violation on cars is a cold air intake. In order to have a cold air intake installed on your car it requires a C.A.R.B. number attached on the part in plain view. The manufactures of the legal parts have always placed them in location were they are plainly visible. I believe the same will follow with motorcycle exhausts. The manufactures of the various exhaust systems will have to do their homework and research were the stamp would need to be located so that is would be plainly visible. Since this would be required for the stock exhaust system that would come with a new bike the aftermarket exhausts systems could place the stamp in the same location.

As far as exhaust noise I have used CVC 27150(a) which states:Every motor vehicle subject to registration shall at all times be equipped with an adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise, and
no muffler or exhaust system shall be equipped with a cutout, bypass,
or similar device. I have only used this CVC twice and it was warranted. An Officer that uses this section really has to be able to articulate the noise level to the Traffic Commissioner. Being able to hear an exhaust at 1,200 feet (measured by my Lidar) from my location, having my police radio volume at full volume and having difficultly hearing my dispatcher definitely fell into the excessive noise category of CVC 27150(a).

I knew it would be a matter of time before something like this would happen in California. We are constantly having citizens who contact the PD and the Mayor's Office complaining about motorcycle exhaust on the weekends. This is mostly from people eating outside at restaurants along one of our main roadways.
