A student from my high school was hit and killed while on his motorcycle.will the

driver of the car be charged? a recent graduate of my high school was traveling south on a highway when a driver of a car who was driving north on the highway waiting to make a turn in a turning lane went for the turn and cut in front of the motorcyclist. Although witnesses of the accident saw the motorcyclist attempt to slow down, he hit the side of the turning car and was killed at the age of 19. Whether or not it makes a difference, he was not wearing a helmet (a practice which is legal in our state).

I am wondering if the driver of the car will be charged with anything such as vehicular homicide, etc.

The driver was not under the influence of any drugs, alcohol, etc. The accident happened just before rush hour in Pennsylvania, where both people involved live.

Since the driver of the car did nothing illegal, but he certainly was negligent, thus at fault. There's just no excuse for not seeing the bike. In Texas he would be charged with negligent vehicular manslaughter. If the driver of the car was in any way impaired, that changes everything,and it becomes aggravated vehicular homicide. If the driver of a car tries to hurt or kill then it gets tough. They don't play around in Texas.... if you kill somebody we kill you back.
