a cell phone driver hit my car can i sue them?

i was driving my 1986 cadillac fleetwood brougham down the road the other day, and i REALLY love that car, its an antique with 32k original miles and its my baby, i took it on its monthly drive tuesday and i stopped at a red light and all of a sudden i saw this camry turn in front of me and it hit the front of my car it only scrapped and dented the bumper but i was very upset because that car has NEVER been in an accident, so i got out and i noticed the guy was on a cell phone and it took him like 5 minuets before he got out because he had to end his conversation with his girlfriend. im getting the car fixed but im still upset over it and the state that i live in has a law that you can't talk on cell phones and drive. so can i sue him?
 
yes you can, but its very difficult to do unless you have a police report. if this ever happens again, you should call the police and it will be regarded as a hit-and-run. then insurance will take over
 
yes you can you are not alowed to talk on the phone while driving you can get a ticket first of all cause it usually leads to an actident like in this case you can actually sue him for the damages cause it is his fault entirely i would sue him for damages and repairs definally
 
yes, you can, obviously he wasn't paying attention, so he can be sued and there's a better chance you'll win. I wont guarantee it, because the law can be swayed if you throw enough money at it.
 
Yes you can Becuase its his fault for talking on a phone while driving at the same time Just listen to how that sounds Lol.And You should do it because Cadillac Fleetwoods Are Very rare And i understand that is your so called "Baby" ^_^
 
if the police report shows him talking on the phone. and he will pay it all if you had a witness you would have a good case on the /ss
 
oh yeah deffinatly you could driving while talking on a cell phone is a big problem these days i would go ahead and take him to court im more than posative you would win your case from the sounds of your story
