2008 Chrysler Sebring won't shift abve 40 MPH 15K miles?

Has had vavle body replaced in Sept. 2008 and again in June 2009. Problem seems to only occur after 30 min or so of driving. When car is turned off and restarted it doesn't do it. Hence, the dealership cannot identify the problem because they cannot replicate it. HELP! It is under factory warranty still
The dealership told me they cannot really do anything if they cannot identify the problem. The check engine light comes on and goes off all the time. Most recently went on 8 hours after the last valve body was replaced. Went off a couple of days later and now two weeks later the shift problem is here again. When I restart the car in the morning it will be fine, so if I take it back to the dealership, they're gonna tell me...they can't see the problem, so they can't fix it. In my research I have found that this "valve body" should have lasted the entire lifetime of the car and now we are on #3. We bought this car 4 mos. ago from CARMAX, as a used vehicle, so we are not covered under any lemon law in our state, as the previous owners was a rental car co.
This car came off the assembly line in March of 2008 and is under manufacuter warranty until March 2011 assuming I stay under 36K. It is only driven to and from work, at a distance of 30 miles total a day.
It can only be touched by Chrylser hands...since their bankruptcy I am limited to this one dealership
Logistic wise
Not sure how to answer a question from an answer but I am putting it here:

The car will drive and then won't shift into the next gear ( think 3rd is the next gear) after 40 mph...the RPMs would go all the way to to the highest if we forced the gas. We have had to stop the car. Apparantly it resets after we turn off the ignition. No fault codes that I am aware of.
The dealership we went to initially was one going out of business and it just said "intermittent transimssion problem". They weren't fixing cars anymore, so we had it towed to the one next closest to us. They just "guessed" it was the valve body, since the check engine light wasn't even on when they got it. It took a week to get the valve body (first one arrived broken). Within two weeks it was doing it again.

It will be going back to the dealership on Tues so they can research it further. This is extremely frustrating on a very recent model car.

Could the car need a whole new tranny?
