1995 Dodge Neon When Cold won't go into reverse or 3rd gear.?

I have a '95 Dodge Neon and when it is cold it won't go into reverse the shifter goes but it does not go. Also it shifts fine from st to 2nd but won't go into 3rd. But when its warm and I hit about 45 i'll shift into N then back to Drive then it goes into 3rd. I changed the fluid and filter and put some cleaning solution in it and it seems to be getting better but I am wondering if a Flush would help or hinder the transmission, the car has 217,000 miles on it and when I changed the fluid it was dark but did not smell burnt. Oh and reverse works when its warmed up.
