I don't know where to fucking start, but here it goes.

So I got in another wreck today.. But this time it wasn't my fault, yay! That doesn't mean jack though, seeing as I have a shit load of problems that came from it. The whole thing went like this: I was driving into town, minding my own business, and oh so excited to go to school.. It was snowing pretty lightly out, but enough to make the roads pretty wet and probably snowed around an inch ontop of what was already there. There was this bitch that was following my ass the whole god damn time, and I remember thinking how much of a stupid bitch she was for following so closely with the conditions like it was. Anyways, I came around this pretty sharp S-Curve, and found a line of about 5-10 cars going extremely slow on the bridge. As I continued to come around, I looked over to see a car totally fucked up from a wreck that happened just minutes ago. At this time I was going about 55mph coming out of the corner, and had very little time to stop. So I slammed on the brakes and literally slid halfway across the bridge (yay for no ABS!), and about a quarter of the way through, I started to fishtail and slide at about a 45 degree angle. I came to a complete stop about 10-15 feet before the line of cars and was thinking "thank fucking god I didn't get into another wreck.." And sure enough, that bitch that had been riding my ass slams right into my car and totally messes up my drivers side front and rear passenger door. The back passenger door is jammed and will not open, and the front door is pretty much the same, but if I jimmy it just right, it will open. Here's the result:

(All the dents and damage was from the wreck, that whole side used to be straight. And that rear door is open up at the top about 2" in result and won't close.)

We pull over once the traffic clears and both get out to exchange info. Some time during this whole process she looks up and says "I can see that this isn't your first wreck.." I sigh and say "yeah", then she had the nerve, SHE HAD THE FUCKING NERVE, to say "You obviously need to learn how to drive." I was already pissed beyond belief before that, and the moment she said that, I yelled out "WHAT!?! Are you kidding me? Did you really just fucking say that after what just happened." That just set the mood for the rest of my day.

Anyways, after all the exchanging, taking pictures and what not, I ended up still going to school. After a few classes and break, I started feeling a little light headed and my neck was killing me. So I take off to the nurses office and she advised I go to the doctors/ER. I take off early from school and go ahead and go to my normal doctors office, and they advise that I go to Boise Minor Emergency because they didn't have a X-Ray or the needed equipment to check me out. When I got there, I filled out some paper work and bring it up to the desk. They ask what I was in for, so I tell them, and they said they couldn't help me cause they don't work with car accidents/car insurance agencies and the only way I was going to get seen is if I went into an actual ER. So by the time I get to the nearest ER, my neck is throbbin. I get checked in and checked out by a doctor, and find out I have a pretty serious case of whiplash. SWEET! He prescribes me 2 different muscle relaxers, and some ibuprofen and also informs me that the pain is suppose to way worse the next day.

After all that is said and done, I head home to relax, and possibly catch some sleep. When I got home my father checks the answering machine, and I over hear someone from the bitch's insurance agency saying she has claim against me and saying the whole thing is MY fault. Way to fucking add insult to injury. I know I'll win this claim, but I couldn't believe she had the nerve again to say it was my fault.

And to add to all this bullshit, the damage to my car is easily worth more than what my car is worth. (They estimated anywhere from 2-3 grand if someone were to fix it.) But the catch is, they value my car to be only $300-400. Which is what they might try to settle for, and if that does happen, I will only get around 60% of it.

It seems as if whenever I take a step forward in life, there's always something that takes me a few steps back. :mad:

TL;DR version:
1. Bitch slams into my car.
2. Bitch turns out to be a bitch.
3. I get serious whiplash.
4. Bitch claims it was my fault.
5. Taters.
6. The total damage to my car is worth more than my car, and they value my car to be $300.
7. FML
 
Wait...

So you where driving WAY to fast in those conditions and you suddenly had to stop...losing control even, but stopped and you didn't expect somebody to slam into you driving just as you where?

But that does suck nonetheless.
 
I was driving the speed limit, yes. She was riding my ass the whole time, which wasn't right for the conditions (the road being wet and all, and the possible chance for black ice.) I could stop in time, she couldn't.

And indeed it does.

WHAT THE FUCK AM I SUPPOSE TO DO? I obviously didn't hit the other cars. And I had no other choice but to slam on the brakes, if I were to do anything else, I wouldn't have made it.

Edit: I know I could of pulsed the brakes, but I'm pretty sure if I did that, I still wouldn't have made it. Even if I DID, that bitch still would have hit me and I probably would have hit the person infront of me anyways.



No cell phone service out here, so no one to call the cops. The nearest town, or possible phone is 10-15 miles away. The cops that assisted the other crash had already left, and there was really nothing we could do. We were both still in shock and I know I couldn't think straight, didn't think of flagging someone down. Sorry.
 
Dear young drivers:

When driving over a bridge in the winter, there will be ice on the bridge whether you can see it or not.

You never, ever, NEVER slam on your brakes on ICE. You WILL CRASH.

You release you foot from the gas pedal and gently tap your brakes to slow down. Yes, you probably would have hit the cars in front of you or been hit by the dumb ass behind you, which brings me to another point:

If you are going so fast that you do NOT realize there is a line of stopped cars in front of you, you either 1--NEED TO PAY MORE ATTENTION or 2--DRIVE ACCORDING TO THE WEATHER AND SLOW DOWN. Regardless of what the speed limit is.

Sorry Spikey, I drive like a gramma because I do not want to wreck, and thus I have never wrecked.

Now backing up is a whole nother issue. I suck at it and have hit an SUV, apartment building, light pole, garbage dumpster, and a creek. Yes, I hit a creek. Shut the fuck up.
 
I'd say it's definitely her fault for following to close, but it may be hard to convince anyone since you slid like crazy. I understand slamming the breaks was your only option. And they can say you were going to fast, but obviously the dumbshit behind you was goign the same speed. Don't forget to mention that.
Whenever I have some douche riding my ass, I hit the breaks hard enough for them to notice and get the message to back the fuck off.
Did you contact your insurance? That should have been the first thing you did after exchanging information.
 
DG he was avoiding a shit ton of traffic from another wreck. What would rather have him do? Slam on the breaks to stop or plow in to a shit ton of other cars? I think the did the right thing! The only other thing he could have done was if he drove into the grass (if there even was any) on the side of the road. The fact that this bitch was following so closely and slams into HIM makes this HER fault.

I've hit 2 cars. One, I wasn't paying attention and smacked into a lady. that one was messy. i take fuuuullll blame for that one. some how i didn't get a ticket. probably cause i was brutally honest with the cop as to what happened and i was almost having a panic attack since it was my first crash.

in the second one what conditions were rotten. it was a very rainy day and i didn't have ABS so my car ran the risk of sliding, like slackers, into other cars. So i was coming close to this car, not knowing that there was freakin mail truck in front of it stopped. i wasn't even close to her. i was pretty far back. i started getting closer and lightly tapped my breaks and tried to turn off into the grass. thing is, as soon as i turned the wheel to my car to go into the grass i hydroplaned a good amount and smacked into the back of the truck. i didn't get in trouble because of the conditions and it was a bad day, but i did everything in my possibility to avoid the accident. no ticket, no slap on the wrist, just a totaled car.

my point is that this is ALL HER FAULT for following toooo closely. slacker may have slid and it may have surprised her and been out of her control, but if she is following too closely then she was being irresponsible. had she not been following so close there would have been no accident.

sometimes shit happens and he did what he thought he should do at that moment and that bitch crashed right into him. in my two accidents i had to pay for the other cars damage with my insurance and out of pocket. i fully accepted that the first accident was my fault. while the second accident was caused by my car and ultimately my fault, i did everything in my ability to stop. i still accept the responsibility for that accident because my car was old and shitty.

this bitch that hit slacker didn't. she just rode too close and slammed into him and now claims that it's his fault. HOPEFULLY, slacker, you later called the police and made a police report about it so that it's at least on file.

i'm sorry about your accident and your whip lash :( it sucks. i taught the day after my accident and it was horrible. please keep us updated with what happens. i hope that stupid bitch gets whats coming to her.

Anyhow, Yeah, it was her fault. She's trying to get out of a nasty repair job. Seriously fight back with your insurance company. Call the cops and tell them what happened. In most cases, it's the person in the back who is at fault. She should not have been driving so close and should have compensated due to the weather. You may have been driving fast for the weather, but she should not have been counting on your driving skills. She knew what the weather was like. She's not blind. She didn't take precautions to make sure she does not hit you. I'm sure the road was icy, but so what. Shit happens. It's not your fault that you slipped and slid on an ice road. You did not get in to an accident. You did not bump in to anyone. She bumped in to you. Call her on it! It does not matter what she or her insurance company wishes to claim the cost of your car is. They didn't inspect it. Who says her car is as much as they claim. Did anyone professional that is on your side inspect her car? NOPE!

You don't have to sit and take this sort of crap from anyone. Call your insurance and the police and a lawyer. She caused you whiplash and you have the hospital reports to prove it. She should pay your hospital bill too! That is legit and perfectly within your rights to claim on her.
 
Well I'm not going to give any driving lessons for once. That's what driver training courses are for. I'll just say this: anytime you lock your brakes on ice, you will end up going further than if you "threshold" brake. You also run a risk of spinning around. If there's already sand on the ice, it's a different story. However, threshold braking is an advanced skill. You have to know your car, and be able to focus on what you're doing even in an "emergency" situation when most people would just freak out.

Anyways...yes the accident is totally her fault. She was behind you, she should've been able to avoid you. There's no legal way she can blame the accident on you. You have to avoid what's in front of you. There's no way you can avoid stuff behind you when you're going forward.

Slacker, get ahold of your insurance company. If you haven't already, talk to the cops. And yes, at least talking to a lawyer would be a good idea also. I'm guessing the bitch has been in at least one accident herself, before. Which is why she's trying to nail this on you right away.

99.999 percent of the time, it's the person in rear's fault. If they cannot prove that the person in front was deliberately stopping fast enough to cause a collision, it's the person in rear's fault. You're car should be repaired at her insurance's expense, as well as any medical bills for your neck.
