xbox 360 wired headset problem?

Hello i have a xbox 360 wired headset and whenever i plug it in to my controller the icon that says im talking comes on but i am not. It even comes on if I have the mic turned off. I can also still hear through the headset. Is there any way i can fix my problem. please help thanks.
 
you probably will have to just buy a new one. they are pretty cheap, just get a used one or something.
