First question, do you HAVE to have standing for either of these?
Now, here is the situation
I dont know uch about either of these maybe you can help with this situation.A mother lets her 16 year old son smoke weed all day everyday.She even offers to buy it for him but he has a job so he doesnt accept.He also has smoked weed with the step father on a couple of occasions, and hte mother told the son to roll the step father a joint etc. and they have smoked together a couple of times.Dcs (children services) got a complaint,investigated and just told the mother, "dont let your child smoke."Thats it,dcs never talked to the child, neither did the mother after the dcs investigation, so the child kept smoking.They got more complaints from different people, same result, "dont let your child smoke."Didnt talk to the child,neither did the mother.He kept smoking.So the cycle continued.He is still smoking to this day and dcs is doing nothing about it.We cannot take dcs to court because we are just average citizens with no standing, we just want the court to enforce drug screens.
writ of mandamus:Is there ANY law that DCS is breaking by not enforcing drug screens?Would this work?If so what law are they violating?
alternative mandamus: I just read about this on wikipedia not sure what it means exactly, please let me know if it is something that canr esolve this situation or if there is ANYTHING else I can do.Thank you
