There was an incident at work where several employees were asked to come to work during a severe weather condition (blizzard) in order to receive their holiday pay for Christmas. Those employees who did not show up to work that day (during the blizzard when state officials issued an order for all people to stay off the roads due to the disastrous conditions) would lose their holiday pay. Does this violate any laws? And if so, which one(s)?
The policy is that you must come in the next work day AFTER the holiday (Christmas) in order to receive the holiday bonus pay. It just so happened that there was at least a foot of snow on the ground with white-out conditions and rapid accumulation. Even the local government issued a statement for people to stay off the roads after a certain time. During this time, the employees would've had to travel to work and the blizzard was only worsening. Many employees chose not to risk their lives and safety by driving into work under these severe conditions. Thousands of other businesses and schools had already closed down early.
If anyone can tell me whether this violates some kind of law, I'd like any ideas/leads.
