Hello,
My name is Chris. I am from Tennessee, and I am very confused on what I should do. I had a very bad car wreck while on the job. I only worked on the job 55 days before the wreck, and I worked on commission only. According to my W-2 form, I grossed $7,353 in my time with the company- Pre-Injury.... However, my AWW states I grossed $4,891- Pre- Injury.
All of the Post-Injury information concerning my return to work numbers are correct... its just the Pre-Injury numbers that are off.
After years of relentless efforts, the employer noticed the inaccuracies and told me that there would have to be changes made, and contacted the insurance company. They are now trying to see if I am entiltled to the lost wages that I never received....
The insurance company did what they normally do to figure my AWW, they went back one year from the date of the accident.... However since I'm on commission I had wages come in after the fact..... do you happen to know if the insurance company has to go back and correct those numbers.... even though they've done it typically the way that they normally do, and thought they were doing it the right way...?
I understand that being commission is sort of unique in this case... I'm just wanting to know what I am entitled to.... because this could change EVERYTHING- my weekly compensation as well as the figuring of my settlement base and amount of dollars of my percentages.
I know you don't know me from atom, but I am reaching for ANY HELP that I can get. I hope this made it to you, and I REALLY have my fingers crossed that you reply.
