I fully intend on asking an immigrations lawyer and or some USA visa authority but first I thought I'd run this by you guys 
Ok so my fiance intends to get a B-2 Visa to visit the USA. The first time she tried she was denied (she didn't mention being my fiance to the interview official, we really thought it wasn't going to be a problem for her to get the B-2 at first). We intend to have her re-apply but this time emphasize that she's going to visit her fiance and that we WOULD BY ALL MEANS get a fiance K-1 Visa BUT we both intend on leaving the country to study abroad in under a year.
The problem with the K-1 Visa is that it requires her to stay in the USA for a period of time during processing and such of the green card (roughly 2 years I think). Yes she could apply for Advanced Parole but that would only allow her to be out of the US for 2 years (we intend to be out for 2 1/2 - 3).
I assume she was denied a B-2 the first time because they were worried she would stay in the country illegally. Fair enough assumption.
However, this time, knowing that if they deny her the B-2 again, I will apply for a K-1 fiance visa, do you think they'll approve her B-2 Visa? We'd really like to do the K-1 but since we're planning on leaving the US shortly it would be a bigger hassle than if we do a B-2 now and then K-1 at a later date.
