Will a state law against same sex marriage stand up in the US Supreme Court?

Keeping in mind the court's motto "Equal protection under the law" and keeping this discussion strictly about law separating a church sacrament or rite from a state contract civil ceremony binding two people to a partnership at city hall or justice of the peace. If my tax money is as green as someone else's and I am free to marry in city hall the partner of my choice, how can I be permitted and another denied? I am not discussing a religious ceremony that takes place in a house of worship. I am discussing a civil ceremony that is equally binding. Please separate Church and state when you answer and keep your answer strictly about the law. If you're going to use the word religion or God or Church it wont be considered and you wasted your time.
 
The issue will rest with what question that the Supreme Court is asked to resolve and what questions are posed during the oral arguments. As well as any amicus briefs presented to the court raising other related issues.

A state that protects "sexual orientation" as part of its constitution or human rights legislation will pass more easily than one that does not.
 
Equal protection under the Law. Why should i not be allowed to marry my Dog, my Cat. Your problem is, there is no seperation of Church & State in the Constitution of the United States of America! It simply does not exist. You show me. Young Man!
 
The supreme court has already ruled that the US constitution prevents a state from restricting who can marry who unless there is a compelling state interest at stake (Loving v. Virginia). So at this point, it's a toss up. Given that the majority of the supreme court is considered conservative with respect to social issues, I think this is the wrong time to start a federal lawsuit. But we'll see.
