Why is Bush not being charged with war crimes?

Okay so I'm not trying to offend any American's who like they guy, but according to the Gineva Convention, he actually did violate it many times over with "detainees" especially in Gitmo. And his war in Iraq was deamed illegal by NATO. Wouldn't that legally mean that all 5000+ deaths of US soldiers were his fault for sending them to an illegal war? Such acts have been cause for other leaders to be charged with war crimes, so why is Bush different?
