Why do authors get sued after having published their books?What do publishers do?

I thought that, before an author gets his/her work published, his/her publishers warn him/her about similarities their work may have with another book.
But this is just a lie.More and more popular authors, like Stephenie Meyer as I have recently learned, are getting sued, because the publishers just didn't do their job right.
Why does this happen?

*No offence to publishers...
