The constitution doesn't specify everything, the founding fathers made it subject to loose interpretation.

It actually IS a judge's job to decide and interpret what the constitution means.

and btw: Gay marriage is being legalized LEGISLATIVELY in several states....
It has already happened in VT, ME, NH
and it is expected to happen in NY & NJ in the near-future.

The legislature is elected by the people and this is after all a Republic.
Any objections?
 
The reality is that none of what Sotomayor said was an issue for them when the speaker was a GOP nominee. Alito clearly said his Italian American heritage gave him unique and superior judgment. GHW Bush praised Thomas for his hard upbringing and his EMPATHY.
 
Their job is to interpret but many are rewriting the law. There is a difference and those that rewrite the law are overstepping their bounds. Why are you beating the gay marriage issue to death this morning? There are many laws out side of gay marriage that apply here?
 
Are you aware that you are wrong.

It is a judges job to apply the law dispassionately.

It is the job of the executive branch to interpret an apply the law.

As for your second point. Things that are made legal within the legislature still can be overturned by the court. It's call checks and balances and the legislature does not work in a vacuum.

So to take just one of your examples. Vermont, where the majority of the people 52% are against same sex marriages 32% are for and 15% had no opinion has a legislature that has bowed to a minority special interest group.

It is a republic.... a Democratic Republic. Yes I do have objections when 90% of the population is coward into a position because a 10% minority want to get their way.

BTW before you question the numbers: Johnson & Johnson conducted their research on alternative lifestyles with an update in the year 2003 and noted that the world wide population of self proclaimed homosexuals is 10% In the U.S the number was closer to 11%.
