Who regulates how life insurance is paid out in court if the beneficiary is challenged?

My husband was recently killed and had an sgli life insurance policy that stated I was the only beneficiary. We were estranged for 7 years but not divorced nor had separation papers. The policy was just drawn up less than one year ago when he named me. His mother and sister have decided to fight the pay out of the policy ( to divide it equally between myself and our children, which is fine, but their are 4 other children that may or may not be my husbands) and they were granted an injunction against it. When it goes to court who determines how much is given to each person, how long does this process take, and can I appeal anything. Someone please help?

Ultimately the answer is, the judge. Anything that happens in a court setting (as opposed to arbitration or something similar) is under the control of the presiding judge.

You're asking a fairly complex legal question that is highly dependant on the laws in your state. You'd be better served to find legal advice in your community. Often you can find a legal professional to help you at little or no cost to you if all you want is advice on how to procede. Your local community center may offer legal clinics. You may also consider contacting the bar association for help finding a lawyer that specializes in this area. Another good resource is to find a student lawyer or paralegal - their rates are usually much lower but they are still perfectly qualified to give you legal advice. Most lawyers offer free consultations to talk about the case and discuss your options.
