Who is the author of the phrase "time is of the essence"?

I've tried searching for it but all I can find are some articles with that title, and none of them say exactly who came up with the phrase.
 
Apparently it comes from the legal profession. I had thought it was from a poem about baseball, where the author said, "Time is of the essence. The players stay the same age, but the man in the crowd gets older every year."
