What will Apple do, will they find out?

they replaced my ipod instore because there was a fault with the lock button, and its jailbroke but with no themes, and the woman said if its jbroke then it voids the warrenty and its been took in and i have a new one now, what will apple do? will they reclaim my ipod? take me to court? im 13 btw
