...copy of his will? We found a copy of his will but the signed copy has conveniently disappeared. They have a long time family business that, according to the copy of the will, should be split between my husband and his sister with the widow receiving a percentage of the profits. My husband's stepmother said she would honor the will but seems to be in no hurry to distribute anything. His sister helped do the bookwork and accounting when my father-in-law was still living. Now she has basically taken over and won't allow anyone but herself in the office or to touch the money. The stepmother seemed content to let this go on as long as she was still getting her money every month but she has recently noticed that the funds in her bank account don't seem to be growing even though all my father-in-laws doctor bills have been taken care of. Is there anything that my husband can do to keep his sister from taking more than her fair share in what should be a FAMILY business? I would like to have my sister-in-law audited because, without going into great detail, it is obvious that she is embezzling from the business. I do not want it to affect anyone else concerned or the business itself. What should I do?
 
Either a valid (original) will exists or it doesn't. If he died without a valid will, then state probate law determines the disposition of the estate. Neither his spouse nor anyone else can deviate from it.
 
unless there is a valid will that specifies otherwise, and depending on the State's laws of intestacy (deceased estate without a will), a surviving spouse inherits the estate of deceased spouse. Your hubby is SOL.
