What is wrong with my 2008 Ford Escape and what should I do?

The transmission seems to be slipping. Recently, for no apparent reason, the battery was also totally dead and needed to be replaced. Some research online has me believe the transmissions on these cars are not great. Should I trade my car in? It only has 40,000 miles. I also would like an SUV because I have a young child and 2 big dogs I cart around. Better gas mileage would be nice but... ah!
 
there should be a warranty that would cover the transmission. unless you do really terrible things to it, it shouldn't be going bad yet. In my experience, the newer fords aren't very reliable. Toyotas are my favorite. i'd trade in the escape and get a highlander or something
