car is worth? ? Ok let me tell you what just happened to me.

A man just recently bought a tow truck from a company called budget towing. He had just recently gotten the brakes fixed by Budget. Well today while he was driving the front left wheel was smoking, so he thought it would be smart to drive it back to Budget to get it fixed. (aka driving an unsafe vehicle.)

So as he is driving down the street (40 mph) the tire pops off the tow truck, rolls across the street down the hill, into the parking lot where I work and smokes the back of my car.

The bluebook value on its is a lil over 5 grand. Now I understand that if the damage is more than the car is worth, i'll get bluebook for it. But since it was his fault shouldn't I be able to get more?

I should also mention that the police officer that wrote the report gave him a ticket for driving an unsafe vehicle and a ticket for not having a proof of insurance. (The officer said that he is guessing he has insurance, but wasn't sure.)
I should also note that I have put over 2 grand into my car with tint on the windows, leather seats, 400 dollar speaker system, a 500 cd player, and 2 subs with amp. Am I able to throw that into the cost of the car?
