what happens when new laws about downloading are brought in?

we all know that in the UK new laws will be passed that could make it possible for those that download music etc illegal to be punished. But music from som websites is free so how will they know if it is illegal, for example on myspace som top artists offer you a free download of thier songs. I also download from some websites but not from programs like limewire. So my question is will this new law be enforced on those who download from websites for free
