what governmental principle is this current event included with?

so this is the event on the news. a man did a hit and run on a pregnant women in stapleton, CO. and the news is saying that in colorado the law is that he wont get charged for killing an unborn child because the baby is not considered a "person" so what governmental principles is this? and does it violate anything in the constitution?


checks and balances, federalism,
limited government, republicanism, popular sovereignty,
separation of powers, and individual rights

and which amendments does this violate or not violate?
