What do you think about New York's dog biting laws?

So here is my opinion, in New York it is 2 bites and the dog is put down. Do they look at why the dog bit, or do they just put them down. I also want to know would someone have to have evidence and witnesses. I just think the law is wrong, I think if it bites there may be a possibility you could get sued. Depending on how bad the bite is and why she bit. My dog, yeah sure she bites, but she only does it because she is scared. Her previous owners before my brothers friend rescued her, either used her to fight or abused her. She has scars all over her, there is one on her forehead its not that noticeable but it is there. I want to know if my dog were to bite, and someone were to try to have her put down, could I argue that in court? I wonder if I had a good lawyer would I win the case. My dog has been through some rough times and the only time she bites is if she is scared, or panics, or something. If someone she doesn't know comes in my room she will get scared and bite (I wont let her, a light smack in the forehead calms her down a bit). But if she were to bite someone, I don't think she should be put down (I want to take her to dog obedience classes, that way she can learn to get along with other dogs).

How can you put down a dog like this?
