Here's a little background info:I have a disabled son. His father and I are separated. I have full physical custody plus medical (because of his special needs) and his father has full legal minus the medical.
My son is with his dad for a full week every other week. I have the opposite schedule. However, due to my exes refusal in court our order is not considered 50/50. My sons time with his father is considered a visitation even though it is half of the time.
My ex was forced to resign as a deputy, so he decided to join the army. He did not inform me until three weeks before he left for boot camp and AIT. This caused my son and myself to be totally unprepared for a drastic change.
In the past two months he has yet to call or write to his three year old.
He refuses to give me any form of contact information. This concerns me because I have no way of reaching him if there is a medical emergency with our son. He told me that if there is anything important I should send it to his home address and his girlfriend will forward it to the base. A father of a friend of mine said that this could be considered AWOL since we have no idea how to contact him.
Right before he left he filled out a family care plan.I did not receive a copy of this plan until later on when they took me to court. My ex made his girlfriend power of attorney and she also accepted the responsibility of my son. According to the paperwork I read though, it looks like you can only fill out this packet if you have either 50/50 custody or full physical and legal custody
A judge overruled his decision and said that it would be irresponsible to leave his disabled toddler every other week with someone who is neither a blood relative or related by marriage and he is not allowed to hand his visitation slot to another person.
Because of this ruling, I assume that now his family care plan is invalid. How would I go about finding contact information to be able to reach him and who would I contact about the family plan? Should I even contact someone?
