I need someone who has a good understanding with Philippine Law in regarding to renting an apartment.
Before me and my husband moved into this apartment, we agreed (vocally) that we only want to stay for 6mos. Weeks after moving in, Landlord's mother, handed us a contract and left. Came back to collect the document as soon its done signed. Due to trust, we signed the document without reading the part that states the length of time we will stay in their property (document says 1yr)
4mos of staying in their property, our car has been damaged and someone stole the car antenna. So we asked if we could move out before 6mos. The Mother of my landlord said YES. Because she knows we had a valid reason. But explained to me that we cannot cash out the money straight away. So i said its fine, were not in a rush coz we still need to look for another apartment first anyways.
The moment we found a place, we had a meeting and the sister of my landlord said that we can leave anytime we wish and we'll get our money back as soon as we fixed their apartment into its original condition the first time we moved in. So we agreed and did what they asked. We fixed everything and asked them to feel free to come over the inspect our improvements with the room and we'll be expecting the refund after. She said she didnt say she will give the money. And said she will give the refund in a month of two after the improvements. My husband got so annoyed and due to that, he swore to my landlord's mother.
Now, they threatened us that they will sue us for my husband's action and for not finishing the signed contract and said they'll do their best to get him deported out of the country (i'm a filipino and my husband is british - both living here in Philippines)
We'd like to file a case, what are our chances of winning? Please help... Thank you...
