My friend wants custody, if not visitation rights, of his child. His son was born in April of 2008. He was there for the birth and provided for his son up until he was a month old. Then the mother, who lived with him at the time, left and took the baby with her because she was angry and they had broken up. She went to live with her parents, and stayed there until the baby was one year old. The father tried to see his son as much as he could, but because the mother's parents wanted nothing to do with the father (because of religious reasons) that wasn't very often. In February of 2009, the father started living with me and my fiance. In April of 2009, the mother and the baby came to live with us as well (the mother and father got back together). The mother found a job and the two decided the father would stay home and take care of the baby until they could get daycare. He did so until almost July of the same year. Then the 3 of them went to Florida with the father's mother where the father worked 6 days a week to provide for the mother and baby. after only about 3 weeks the mother decided that wouldn't work and came back up to live with us. She left the baby with her parents while she was still with us and got back into her job that she had previous while living with us. The baby stayed with her parents without her for a month and half. After that the mother and father talked, they had broken up again, and they both decided that the baby would stay with the father for 4 months. so the mother got the baby and kept him for her and us for 1 day so that the father could could get him. the father drove 18 hours to get the baby from her. Halfway into the trip the mother called her parents and told them to come and take the baby before the father could get him. She called the father and told him he could forget about taking the child. when that happened the mother moved back in with her parents. the father started calling at least twice a week to see how his son was but never once was the phone answered and never once did he receive a call back. he hasnt been able to see him son since july of this year (2009). since the baby was born, the father has been in and out of jobs, as has the mother. the mother has lived with 4 different people since the baby was born and the father has lived with 3 different people. the father is and has not been in college. the mother has been in and out of college. neither of them have been to court to get full custody. the father has tried to be a part of the childs life as much as possible and has never once left him. the mother has taken him away from him 3 times solely because she believes the mother always has full rights over the child. they have not been to court, so no child custody has been awarded. and neither one of them has been ordered child support either. the father has never been on drugs, has never been an alcoholic and has never been abusive. when he was able to care for the child, he did a great job. the mother on the other hand.. with the baby in the car she rammed her car into the fathers car when he was about 6 months old. she has had at least 2 speeding tickets with the baby in the car, one of which was child endangerment but the cop let her off. she also attempted suicide while she lived with us the baby and the father. we have pictures that she took of herself while she was diving with no one else in the car but her and the baby, some of them you can see she wasnt looking at the road. we have pictures of the father being there for the baby. we can get records of the hospital visit for attempted suicide. although we have no proof for a bunch of other things, including some mentioned, we do have 3 people willing to testify for all of the accounts. the only problem is the father has is he has no money for courts to get custody of his child.even though she currently doesnt really have custody either, he has no way to get his child. he lives with us again and currently doesnt have job. she doesnt have a job right now either. other people besides the parents have been paying for this child for most of his life.
can someone please give us advice
