Back in 2007 my fiancé and I got into financial straits and we couldn't afford his truck payment anymore so we voluntarily get repossessed. The bank wasn’t happy about this, even though the truck was paid for until the day it left. The truck was pretty much a lemon when he bought it, but he was young, impulsive and had a good job working construction at the time, so he bought it. After a year the trucks transmission went out (he bought the warranty on it as well) but it turns out the dealership he bought the truck through wasn’t supposed to sell this warranty and was not accepted so he paid for a new transmission out of pocket. Then Jan of ’08 the trucks engine blew a head gasket (one again was not covered by the warranty even though it should have been…since then the dealership and warranty place have both gone under and are being investigated by the government-haven’t heard anything as of yet).
So back to the bank, since the truck was financed through them (with his and his mother’s name) and we and she could no longer afford the payments (she had been making them most of ’08 due to losing his job) we told the bank to let it be repossessed. We took the key in and the financial advisor, or whatever she was (she was a b**** for a lack of better words) asked if the truck was in the parking lot, he told her no, she asked why and was told the engine was blown how was he supposed to drive it there. She retorted with “When did this happen? Last night?” Now I’m sorry, times are tough but you don’t rub it in someone’s face. So because of this situation, they called his mother and said they would no longer like her business, so she pulled her money and found another bank. The truck was picked up the next day, went to auction and sold for 900, when he owed 5 or 6,000 on it still. He also got a loan through the bank to pay off several of his credit cards. Since he was unable to pay the loan back, he was sent to the banks lawyer and was served with paperwork to go to court, but never told the date, time, and where. A month later he was sent a letter saying he lost and had to pay back the loan or his wages would be garnished, but lucky for us he was collecting unemployment and they can’t garnish that type of income. He now has a full time job, as do I, but since we are so far behind in bills we really can’t afford for him to have his wages garnished. How long until a lawyer finds out he has a job and can garnish his wages. He plans to file bankruptcy (not proud of it but we really can’t afford another large monthly payment) but he’s sweating the garnishment plans which is stressing me the hell out too.
