Updating my HTC Herp Android Phone?

I've recently attempted to install an application (Grooveshark) only to find that it apparently doesn't exist in the marketplace, even though I know it does.
The only reason I can think of why it wouldn't appear would be because my phone isn't updated. I've never done and update and I have no idea how to do so.
If anyone could help me do this then I would appreciate the help a lot!

If there are any updates it should automatically ask you to update but if not go to setting then go to about phone and there should be a system updates button click on it and it will tell you if there is any updates and if so click on them and it will update. Are you sure that the app is made for the version you are running. The android market will only show you apps that run on your version of android.
