update, whats next?

Hello all,

Well I just got back from my appointment with the Dr that my lawyer has sent me to. I can't believe what happened, he showed me all of reports from my my first MRI to discogram, surgery notes, Ct scans. etc. History: I had a WC injury, the first MRI showed that i had a three level injury, L-3 thru S-1, after my discogram my surgeon said that L4-5 needed surgical repair and that the other two levels were "ok". HE told me even before the discogram that he would not operate if more than one level was in need of surgery. I had my Surgery 05/07 on the one level, long story short, I am sill in pain, it is even worse that before surgery. The Doc has since "relesed me to PM Dr for long term chronic pain, and said there was nothing left for him to do. Well the new DR showed me the discogram/Ct scan report from pre-surgery that showed all three levels had "concordant pain with posterior grade 5 tear to ALL THREE levels!
As my new DR explained how could I not be in pain, when two of the levels were never repaired, and that the fusion to l4-5 could have actually made the upper and lower levels worse off from the added strain!
He's putting together a plan of treatment, however he said because of the way my surgery was done I am only looking at 25% chance of success. He also said that I have a long road ahead of me and a uphill clirab with WC. I am so angry, but happy I have someone on my side for a change.

Lisa, I'm so very sorry that the first surgeon was such a money-grubbing jerk that he operated on one disc knowing full well that others discs were also in need of work. I hope this attorney is suing the pants right off this so-called "doctor" and that he is put out of business. What a horrible thing to do to a person who puts their future in your hanRAB.

If you haven't discussed a lawsuit, then you should do so but make sure the attorney is well suited to personal injury claims. You deserve to be compensated for the gluttony and unprofessionalism of your first surgeon. I know that money can't give you back your well-being but at least you would have the satisfaction of your day in court.

I'm so sorry that the prognosis isn't better and I hope you will be one of the lucky 25 percent that do get better.

lisa((((((((((((((((hugs)))))))))))))))) I am so sorry to hear this, this kind of news is what gets to were i want to just stop going to dr.s and deal with it forever, but i know thats not the case with all it's scary. I am here for you whenever you need an ear!

Wow, Lisa! I'm not big on all these lawsuits that Americans are so quick to jump into, but there's a time and a place! I agree with Carol; have your lawyer look at the documentation and see if he thinks you have a case. It sure sounRAB like it! Maybe WC neeRAB to have their wagon fixed! They're so pathetically stingy on giving appropriate medical care, maybe a few lawsuits will encourage them to do what's right in the first place!

What is so sad is that you will be the one to suffer for years to come. I am so sorry this happened to you. (((HUGS)))
 
I too am so sorry for your injuries, but I am very glad that you have found someone who seems to be on your side and wanting to help your from this point on. It is hard enough to deal with w/c, you didn't need a Dr. to add insult to your injury.

Please know that you can always come to ask questions as well as to vent, and you deserve to vent when things like this happen. Please keep us updated as you progress through your treatment.

Thanks guys,

My mind has been spinning every since all this happened. I can hardly wait to get my hanRAB on all of my medical files. I am going to go through them with an eagle eye. I was a nurse before all of this happened, I think that is one of the things that hurts the most my own profession has let me down so badly. I was always upfront with my patients a never left them in the dark. How niave to expect the same kind of care in return. I pray that you all are in the hanRAB of wonderful healthcare team. I know it may not seem like it but there are those that care and truly do their best for us. We have to keep ourselves informed and fight the good fight.

Lisa, yes keep your chin up! Not all nurses are bad! I have had more bad experiences with MD as they let me down all the time, made me think i was going crazy and all! Glad to know i'm not!!!
