Unlocked ATT cellphone requiring a data plan?

I want to buy an ATT cellphone from ebay or amazon, but I want one that usually requires a data plan. My contract doesn't include a data plan, so if I bought the phone, would I need to upgrade my contract? Would it be possible for me to just use the phone and not use the internet or the other things that the data plan is for?
Any help would be appreciated!!! Thanks
