Under UK law, is it illegal to use assets from a CVA company to launch a new company?

Obviously I'm not asking for a legally binding opinion, but for those among us who know....

Is it legal for a company in such dire trouble as to go into a CVA to use those exact assets (aka employees) to launch a new compaany?
